A divorce lawyer in Karachi helps a husband issue a valid talaq notice to the Union Council, or helps a wife obtain khula or dissolution through the Family Court. Under Section 7 of the Muslim Family Laws Ordinance, 1961, a divorce takes effect 90 days after notice unless it is revoked first.

Khula Procedure in the Family Court
The wife files a suit for dissolution of marriage on the basis of khula in the Family Court, usually where she lives. The court issues notice to the husband and attempts reconciliation at the pre-trial stage. If reconciliation fails, the court can decree khula. It may direct the wife to give up her dower or return what she received.
The court then sends a certified copy of the decree to the Union Council Chairman within seven days. The Chairman treats it as a notice of talaq, and the 90-day period runs from there. We follow up with the Union Council so that the divorce certificate is actually issued.
Rights After Divorce
- Dower (haq mehr): unpaid dower remains payable, unless it is given up in a khula.
- Maintenance: a former wife can generally claim maintenance for the iddat period, and children remain entitled to maintenance.
- Dowry and personal belongings: these can be recovered through the Family Court.
- Custody: custody and visitation are decided separately on the welfare of the child.
Failing to send the talaq notice to the Chairman is itself an offence under Section 7 of the 1961 Ordinance, and it can cause serious problems if either person later remarries. It is worth getting this step checked even if the divorce happened some time ago.
Divorce for Overseas Pakistanis
If you live abroad, you can usually act through a representative holding a properly attested special power of attorney. A divorce obtained abroad may also need legal advice before it can be relied on in Pakistan, particularly for NADRA records and remarriage.

Talaq Procedure in Karachi
- Draft the divorce deed and notice. The husband signs a written pronouncement of talaq and a notice to the Chairman.
- Serve the notice. The notice goes to the Chairman of the Union Council or Union Committee, with a copy to the wife.
- Reconciliation period. The Chairman forms an Arbitration Council within 30 days to attempt reconciliation.
- Ninety days pass. Unless revoked, the talaq becomes effective after 90 days. If the wife is pregnant, it takes effect at the end of the pregnancy if that is later.
- Certificate. The Union Council issues a confirmation of divorce, and a NADRA divorce certificate can then be obtained.
Frequently Asked Questions
How long does a divorce take in Pakistan?
A talaq takes effect 90 days after the Chairman receives notice, unless it is revoked. For khula, the Family Courts Act directs the court to decide within six months, though the actual time depends on service of notice and how the case proceeds. The 90-day period then runs after the decree reaches the Chairman.
Can a wife get a divorce without her husband’s consent?
Yes. A wife can file for khula or judicial dissolution in the Family Court without her husband’s consent. If she holds the delegated right of divorce in column 18 of the nikahnama, she can also use talaq-e-tafweez.
Is a verbal or WhatsApp talaq valid in Pakistan?
The legal procedure requires written notice to the Chairman of the Union Council with a copy to the wife. Do not assume that a verbal or message-based talaq has completed the legal process. Take advice on your own facts, as this affects your status, your rights and any remarriage.
What documents are needed for divorce in Karachi?
Normally the nikahnama, CNICs of both spouses, the wife’s current address, children’s details if any, and the divorce deed or court decree. A power of attorney is also needed if you are acting through a representative.
Who gets the children after divorce in Pakistan?
Divorce does not settle custody automatically. If the parents do not agree, the Guardian Court decides on the welfare of the child under the Guardians and Wards Act, 1890, and can order visitation for the other parent.
